“The California experience during 1848 to 1866 provided an excellent opportunity to test the hypothesis developed in this study. There were no legal restraints on miners’ behavior over the acquisition of rights to mineral lands. Similarly, there were no groups in California prior to the gold discovery that were strong enough to establish and maintain exclusive rights through the use of physical force. The gold land had no alternative uses of any significant value; this greatly simplified the problem of identifying the costs of establishing mining rights. The emergence of an explicit property-rights contract occurred not once but 500 times. And the length of time in which this took place was not centuries, but days."
